Terms of use

1. Agreement to Terms

By accessing the Moonworks website or using our services, you agree to be bound by these Terms of Use. If you disagree, do not use our services.

2. Eligibility

You must be at least 18 years old and legally able to enter into a contract to use Moonworks services.

3. Services

Moonworks provides brand design, website design and Webflow development as fixed price projects (Launch Page, Sprint and Rebuild) and optional monthly retainers (Keep, Ship and Scale). Anything outside the agreed sitemap or scope is a change request: we quote it in writing and start only once you approve it. We reserve the right to modify or discontinue any service at our discretion; this never changes a quote you have already signed.

4. Projects, Retainers and Payments

• Projects are fixed price and fixed scope, as set out in a written quote. Quotes are valid for 30 days.
• No work starts before the deposit is received. Launch Page and Sprint: 50% at signature and 50% before the site goes live. Rebuild: 40% at signature, 30% when the design is signed off and 30% before the site goes live.
• Optional retainers (Keep, Ship and Scale) run for a 3 month minimum, then continue month to month until either party gives 30 days' written notice. Retainers are billed monthly in advance.
• Late payments carry statutory late payment interest plus a EUR 40 recovery fee. If an invoice is still unpaid 10 days after its due date, we may pause work until it is settled.

Payments are securely processed through approved providers such as Stripe.

5. Intellectual Property

• All pre-existing tools and processes remain Moonworks property.
• On full payment, all files and intellectual property in the deliverables created for you transfer to you.
• Moonworks may display work in its portfolio unless otherwise requested in writing.

6. Client Responsibilities

You agree to:

• Provide accurate, timely information
• Supply materials that do not violate third-party rights
• Use services lawfully and respectfully

If feedback, content or access arrives late, the delivery date moves by the same number of days.

7. Confidentiality

All non-public project information shared between the parties is strictly confidential.

8. Disclaimer and Limitation of Liability

Services are provided “as is.” Moonworks is not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the total fees paid in the 3 months preceding any claim.

9. Termination

We may suspend or terminate access if you fail to comply with these Terms or miss payments.
Outstanding amounts remain payable upon termination.

10. Governing Law

These Terms are governed by the laws of Portugal. Any dispute shall be settled by the courts of Lisbon, unless consumer law requires otherwise.

11. Changes to Terms

We may update these Terms periodically. Continued use of our services after an update constitutes acceptance.

Refund and Cancellation Policy

‍

1. Retainer Cancellations

After the 3 month minimum, you can end a retainer with 30 days' written notice by emailing contact@moonworks.agency.
Cancellation takes effect at the end of the notice period.
You’ll continue to receive services until then.

2. Refunds

Due to the nature of creative work, we do not offer partial or prorated refunds once a retainer month or project phase has begun. In exceptional cases, Moonworks may offer a discretionary credit.

3. Fixed Price Projects

The deposit paid at signature is non-refundable once work has started, except where Moonworks fails to deliver as agreed. Later payments fall due at the milestones set out in section 4.

4. EU 14-Day Withdrawal Right

If you are an EU/EEA consumer, you have the right to withdraw within 14 days of signing your quote, unless you request that we begin work during this period, in which case the right is waived.

5. Refund Exceptions

Refunds will not be issued if:

• You fail to provide feedback or files on time
• Dissatisfaction arises from subjective preferences
• The service has been substantially completed

6. Service Modifications

Moonworks may change its offers or prices with reasonable notice. Changes never affect a quote you have already signed.
In case of termination, refunds may be prorated at Moonworks’ discretion.

By using our website or signing a quote for our services, you confirm that you have read, understood,

and agreed to the terms above.
